Livermore Police Chief's letter to the community on local immigration policy

Livermore Community,

Immigration is an important and sensitive issue in many communities. The belief that local police departments could begin targeting individuals based on their immigration status has caused uncertainty and fear among many of our residents.

The Livermore Police Department wishes to reassure our community that we are committed to protecting and treating all individuals equally, without regard to race, color or national origin or in any way that would violate the United States or California Constitutions.

To ensure a safe community, all individuals, regardless of their immigration status, must feel secure that contacting or being contacted by the Livermore Police Department will not make them vulnerable to deportation. We want to encourage victims and witnesses to contact our departments about crime without fear of reprisal. Without this type of cooperation and trust, crime will go unreported, community safety is impacted and we are less effective as public servants.

For this reason it is our policy that the immigration status of individuals, absent other criminal behavior, is not a matter for local police action. Members of the Livermore Police Department will not attempt to determine the immigration status of crime victims and witnesses or take enforcement action against them based on their status. The only exception to this rule would require circumstances in which a person is suspected of being involved in violating criminal laws and is a threat to public safety. In those rare circumstances both probable cause and supervisor review will be required. In no case will an individual who is otherwise ready to be released continue to be detained only because questions about the individual's immigration status are unresolved.

It is not the intent of LPD’s policy on immigration to give the City of Livermore “Sanctuary City” status. We will continue to cooperate with our federal law enforcement partners. Requests by ICE, or any other federal agency, for assistance from this department are directed to a supervisor and depending on the circumstances, department staff may provide available support services, such as traffic control or peacekeeping efforts, to ICE or other federal agencies; However, Livermore Police Officers will not take enforcement actions on immigration offenses.

We understand there is concern and fear in certain segments of our community over this issue. It is our hope that sharing this message will lead to a better understanding that reduces fear and builds trust. We appreciate the support of our community and look forward to continuing our mission of “Service with Honor, Protection with Purpose.”

Sincerely,

Michael D. Harris
Chief of Police
